Electronic-Billing Presentation Service


1. Acceptance of Terms

1.1 Welcome and thank you for using GTT's e-Billing Presentation Service (the Service), marketed as "Myaccount." TheTerms and Conditions of Service set out below also includes GTT's Acceptable Use Policy and GTT Privacy Policy [the Documents] which together articulate Your rights and obligations and those of GTT, its officers, agents, employees, contractors, vendors and affiliates ["we, us, GTT"]. Before using this service you are advised to familiarize yourself with this Service Agreement and all of its amendments. This Agreement becomes effective from Your acceptance thereof, by clicking on the "I Agree" box during the service registration process. By accepting the Terms and Conditions and using the Service you agree to be bound by all of the Terms contained therein.

1.2 GTT reserves the right to modify these Terms from time to time and such modifications will be effective immediately upon posting of the Amendment . You agree that by using the Service after any such modifications, you will be deemed to have read, agreed to and accepted the modified Terms. At any time that You do not agree to be bound by these Terms You should immediately end Your use of the service and terminate Your subscription.

1.3 Thank You again for using Myaccount.

2. The Service

2.1 The Service, which is offered to You free of charge, allows post-paid wire line, DSL and mobile customers, who have registered for the Service on-line to, among other things, access, view, save, and print their post-paid service bills and generally manage these accounts (e.g. add services for e-billing presentation) from anywhere that Internet access is available.

2.2 Any billing information You access using the Service is believed to be reliable. However, GTT provides the Service on a best-efforts basis for Your convenience and will not be liable for any deficiencies in the accuracy, completeness, availability or timeliness of such information or for any decision made using this information. Further, insofar as GTT does not guarantee that the information provided with respect to current and historical bills is accurate, complete, or error-free, the company reserves the right, at its discretion, to correct any error in the Service or monthly billing statements at any time.

2.3 In order to use the Service You must register on-line by accessing the portal. You may access the portal by typing https://myaccount.gtt.co.gy into the Address Bar of Your browser. The portal can be accessed (and renders well) on desk-tops, lop-tops, tablets and Smart phones. You will be required to select an account type (e.g. wire line, DSL, mobile), and to provide the line number, the service account number and an invoice number from any bill dated within the last three (3) months. You will also be required to provide and confirm an email address, and agree to the Terms and Conditions of Service by clicking the appropriate box. This completes the registration process and all of the information required can be found on paper telephone bill. Having successfully registered, an email will be sent to the email address You provided. You are now in a position to change Your temporary password.

2.4 If you are a new service customer (who has never received a paper bill for your post-paid service) wishing to register on Myaccount, then rather than providing an invoice number during the registration process, You will be required to enter the unique number from the ID used to apply for service (e.g. number from National Identification Card, Passport, Driver's License, Business Registration/Articles of Incorporation). All registrants are encouraged to use the "Chat" facility on the Myaccount portal to for assistance at any point during the registration process.

2.5 Upon successful registration for the Service, You will be able to view up to six (6) months of on-line bill history. However, a longer bill history can be provided by GTT upon request and payment of the PUC-approved charge.

2.6 You will receive an email every month when new billing information becomes available for access via Myaccount. You will also receive such notification whenever you make a change to Your profile information or password. If you provided a GTT mobile number at the time of registration and have activated an SMS account on that service, then you will be in a position to also receive SMS notifications from Myaccount.

2.7 You agree not to intentionally provide false information when registering for, accessing or using the Service. You also agree that you will not falsify or otherwise tamper in any way with any information sent You via email by GTT. Further, You agree not to make Your account particulars available to any unauthorized individual(s) to access the Service.

2.8 You understand and agree that You can only register for paperless bill presentation through Myaccount a post-paid service which belongs to You. You agree too that use of the Myaccount service is not transferrable.

3. Paperless Billing

3.1 You understand and agree that stopping your paper bill means that you will no longer receive a paper copy of your GTT telephone bill through the mail.

3.2 Further, You understand and agree that any legal, regulatory or other notice which GTT is required, or needs, to send You will only be sent on-line through Your account or to the current email address associated with Your account. If any email to you is returned to GTT as "undeliverable," GTT will contact you by phone to determine any necessary changes in your email address.

3.3 You understand and agree that Your obligation to clear your service bill by the due date is not altered or modified in any way by stopping your paper bill.

4. Service Cancellation and Termination/Discontinuation

4.1 GTT aims to ultimately become a paperless company. Thus, over the medium- to long-term every customer will cease to receive paper bills as billing information will only be provided electronically. In the circumstances, GTT encourages You not to cancel Your registration for the Service. Further, having registered for electronic (paperless) billing presentation, you must retain the service for a minimum of twelve (12) months before you can cancel your registration. In the unlikely event that you do wish to cancel your registration for the Service, please contact GTT's Customer Care Representatives on 0488 and be ready with all of the pertinent service/account information

4.2 In addition to any other remedies available to the company, GTT may, without notice and without liability to You, terminate, suspend, or discontinue provision of the Service if any of the following occur:

a) GTT deems such action necessary to protect against fraudulent or illegal use or to otherwise protect the company, its equipment, networks and facilities;

b) You fail to comply with Your obligations under these Terms

c) The PUC orders GTT to discontinue provision of the Service.

GTT will send you reasonable notice if it is required to suspend or terminate the Service.

4.3 Neither Your service cancellation nor GTT service termination shall affect your liability or obligations under these Terms and Conditions. These actions merely affect Your paperless billing service, they do not erase Your liability for service bills incurred by You. You continue to be responsible for making your service payments in a timely manner.

5. Privacy Policy

5.1 GTT takes seriously the protection of sensitive and personally identifiable information you share with us. We will never rent, sell or give to third parties for marketing or mailing list purposes without your express permission. Such personally identifiable information as GTT collects from You during the registration process will only be shared in compliance with a court order or as otherwise required by law. Our servers may maintain logs of user activities to help our Customer Service Representatives to better understand and cater to your needs and to better manage the e-billing portal.

5.2 GTT's current privacy policy can be found on GTT's website (http://www.gtt.co.gy/) and is expressly incorporated into these Terms by this reference.

6. Intellectual Property Rights Policy

6.1 The Services shall not be used to publish, submit/receive, upload/download, post, use, copy or otherwise reproduce, transmit, re-transmit, distribute or store any content/material or to engage in any activity that infringes, misappropriates or otherwise violates the intellectual property rights or publicity rights of any individual, group or entity, including but not limited to any rights protected by any copyright, patent, trademark laws, trade secret, trade dress, right of privacy, right of publicity, moral rights or other intellectual property right now known or later recognized by statute, judicial decision or regulation.

6.2 GTT's current Acceptable Use Policy can be found on GTT's website (http://www.gtt.co.gy/) and is expressly incorporated into these Terms by this reference.

7. Disclaimer of Warranties

7.1 The GTT Myaccount service, as well as such content, information, software, functions, etc. provided on or through it, are made available on an "as is" and "as available" basis. GTT makes no warranty that MYaccount data and information will be timely, secure, uninterrupted, or error-free. GTT will not be responsible for any errors, omissions, interruptions, deletions, defects or delays in the operation of the Service or transmission of data through the Service. GTT MAKES NO EXPRESS OR IMPLIED WARRANTIES WITH RESPECT TO THE PORTAL OR THE MYACCOUNT SERVICE, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation on Liability

8.1 GTT's LIABILITY TO YOU IS LIMITED. YOU AGREE THAT GTT, ITS AFFILIATES AND SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, SUPPLIERS AND LICENSORS SHALL NOT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSSES OR EXPENSES WHICH MAY ARISE FROM YOUR OPTING OUT OF PAPER BILLING AND YOUR ACCESSING THE E-BILLING PORTAL AND USING THE MY ACCOUNT SERVICE, OR IN CONNECTION WITH ANY FAILURE, ERRORS, OMISSIONS, INTERRUPTIONS, DEFECT, VIRUSES, SYSTEM FAILURE, OR TRANSMISSION DELAYS. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.

9. No Modification of Other Agreements

8.1 Nothing in these Terms and Conditions shall modify your obligation to pay your GTT service bills when they are due, consistent with the Terms of the particular service contract. The e-billing service only changes the manner in which your bill is presented.

10. Governing Law

Your access to and use of the e-billing portal and related GTT website shall be governed by and in accordance with the laws of Guyana and You agree to submit to the jurisdiction of the Guyana courts

FIRST AMENDMENT

GTT Terms and Conditions of Electronic Bill Presentation Service

1. This amendment to the original Terms and Conditions of GTT's Electronic Bill Presentation Service (the "Amendment") is made unilaterally by GTT consistent with clause 1.2 of the said Terms and Conditions of Service. This amendment becomes effective immediately upon its posting.

2. The Terms and Conditions are amended as follows:

o The numbering of clause 2.1 is modified and now reads clause 2.1(a).

o A clause 2.1(b) is added and reads as follows:

"The Service is also offered free of charge to Pre-paid Mobile customers. Pre-paid customers have no billing information to check on Myaccount. However, their registration will permit them to, among other things, check their core, promotional and data balances and their expiry date, subscribe to mobile data service on their BlackBerry or other Smart Phone, access a history (the last five transactions) of their data transactions.

o The numbering of Clause 2.3 is modified and now reads clause 2.3(a).

o Clause 2.3(a) is modified and now reads as follows:

"In order to use the Service, post-paid customers must register on-line by accessing the portal. You may access the portal by typing https://myaccount.gtt.co.gy into the Address Bar of Your browser. The portal can be accessed (and renders well) on desk-tops, lop-tops, tablets and Smart phones. You will be required to select an account type (e.g. wire line, DSL, mobile), and to provide the line number, the service account number and an invoice number from any bill dated within the last three (3) months. You will also be required to provide and confirm an email address, and agree to the Terms and Conditions of Service by clicking the appropriate box. This completes the registration process and all of the information required can be found on paper telephone bill. Having successfully registered, an email will be sent to the email address You provided. You are now in a position to change Your temporary password.

o A Clause 2.3(b) is added and reads as follows:

"In order to use the service pre-paid customers must also register online by accessing the portal at https://myaccount.gtt.co.gy. You should select "pre-paid mobile" from the drop-down menu, enter Your mobile number (e.g. 592 621 XXXX) and select "next step." A temporary PIN will be sent to Your handset. This PIN and Your email address must be entered in the appropriate boxes. You must read and agree to the Terms and conditions of Service before Your registration can be successful. Thereafter, a temporary password will be sent to the email address provided to facilitate your login to myaccount. Upon logging in, You will be prompted to change the temporary password."

3. Except as set forth in this Amendment, the Terms and Conditions of the Electronic Bill Presentation Service are unaffected and shall continue in full force and effect in accordance with its terms. If there is conflict between this amendment and the Agreement, the terms of this amendment will prevail.
